This Policy covers the collection and use of Personal Information by MarginEdge Co. when you visit, access or use our websites and related products and services, including our mobile applications (individually and collectively, the “Sites” or “Services”). Our Sites and Services are designed for businesses and are not intended for personal, family, or household use. This Policy applies to information about individuals in their capacity as owners, employees, or other representatives of our business customers, prospective customers, vendors, and partners. It does not apply to any third-party site that may be linked to our Sites.
We process information that our customers submit to or process through the Services, such as invoices, vendor records, recipes, inventory, sales, and labor data, to provide the Services. As described in our Terms of Service, we may also use this information in aggregated and de-identified form for analytics, benchmarking, product development, and machine learning model training. We maintain and use de-identified information in de-identified form and do not attempt to re-identify it, except to determine whether our de-identification processes satisfy the requirements of this paragraph.
Introduction
“Personal Information” is information that can be associated with a specific person and used to identify that person. In this Privacy Policy (the “Policy”), “MarginEdge”, “we”, “us” and “our” refer to MarginEdge Co.
The information we collect about you
Information you provide.
We collect Personal Information that you provide to us, including your name, title, company name, mailing address, email address, mobile phone number, and, where applicable, text messaging opt-in status, consent records, and related messaging preferences. We may also collect demographic or corporate information, your industry and market segment, vendor names, unique identifiers, and your preferences and interests. We collect the payment card or bank account information you use to pay for your subscription. If you use our bill pay services, we collect bank account numbers, routing numbers, and account-holder names, for you and for the vendors you pay, as well as payment card information if you choose to fund payments by card. Vendors who enroll to receive electronic payments provide their legal business name, federal tax identification number (which, for sole proprietors, may be a Social Security number), business address and phone number, contact name and email address, and bank account information. If you use our payment services, MarginEdge Funding, or the MarginEdge Card, we also collect information needed to verify identity and determine eligibility, such as taxpayer identification numbers, identity information about your business’s owners, authorized representatives, and users, and financial statements.

When you visit our Sites, we, our service providers, and our advertising partners use cookies, pixels, and similar technologies to automatically collect information about your device and how you use the Sites, including internet protocol (IP) address, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We may associate this information with Personal Information you provide to us.
What we do with your information
We use Personal Information to provide, operate, personalize, and improve our Sites and Services; to verify bank accounts, screen vendor enrollments for identity verification and fraud prevention, and process payments at your direction; to provide you with notices about your account/subscription and changes to our Sites; to send you marketing communications and show you advertising for our Services on other websites; to analyze use of our Sites and measure our advertising; to protect the security of our Sites and Services; and to comply with our legal obligations and carry out our obligations and enforce our rights arising from any contracts entered into between you and us.
Who we share it with
We may share Personal Information with MarginEdge’s controlled subsidiaries and affiliates. Consistent with the purpose of the Sites, we may also disclose information you provide to us to people you are connected to through the Sites, such as your employees, employers, and co-workers.
We share Personal Information with companies that provide services on our behalf, such as hosting websites, processing transactions, supporting sales and client interactions, and analyzing our Sites. For bill pay and other payments, we share bank account, payment card, and related information with banks, payment processors, payment networks, check printing and mailing providers, virtual card issuers, and identity verification and fraud prevention providers, as well as government entities, as needed to complete the transaction or meet legal requirements.
If MarginEdge sells, buys, merges or otherwise reorganizes, we may disclose Personal Information to prospective or actual purchasers.
We may disclose Personal Information to government entities and others if required to do so by law or legal process, to protect our rights or property, to protect the personal safety of any individual, or at your direction. If you are located outside the United States, your Personal Information will be transferred to, stored, and processed in the United States.
About text message communications
If you provide your mobile phone number to MarginEdge and opt in to receive text messages, MarginEdge may use your mobile phone number to send you service-related, account, support, transactional, or other messages consistent with the consent you provided. Message frequency may vary depending on your relationship with MarginEdge and the nature of the messaging program. Message and data rates may apply.
You may opt out of receiving text messages at any time by replying STOP to any text message from MarginEdge. You may request help by replying HELP or by contacting us at help@marginedge.com.
MarginEdge does not sell, rent, share, or otherwise disclose mobile phone numbers, text messaging opt-in data, or text messaging consent information collected in connection with its text messaging program to third parties or affiliates for their marketing or promotional purposes. MarginEdge may share this information with service providers that help us send and manage text messages, but only as necessary to provide those services for MarginEdge and subject to confidentiality and use restrictions.
AI assistant connections
MarginEdge offers connections that allow AI assistants, such as ChatGPT, Codex, and Claude, to read your MarginEdge data when you sign in and authorize the connection. These connections are read-only; they cannot create, change, or delete data in your account.
When you connect an AI assistant, it receives your account identifier and may receive your name, email address, as well as the restaurant business data you can already see in MarginEdge, such as orders, invoices, vendors, products, inventories, recipes, sales data, and profit-and-loss reports. Depending on how your business uses MarginEdge, this data may include personal information, such as the names of vendors who are individuals, payment account names, free-text notes, invoice documents, labor costs, and the usernames of team members who performed actions in MarginEdge. The AI assistant provider (for example, OpenAI or Anthropic) receives the data you request through the assistant. MarginEdge's hosting provider and sign-in provider process the connection on MarginEdge's behalf.
Each time an AI assistant uses the connection, MarginEdge records your account identifier, which AI assistant made the request, which function was called, what was requested, and the outcome, but not any password or access token. MarginEdge also records the IP address, browser or app identifier, and request details in its access and server logs.
You can disconnect MarginEdge from an AI assistant at any time through that assistant's settings. Access also ends when your MarginEdge account or role ends. Our sign-in provider also logs each AI assistant sign-in, including your email address and IP address.
Third-party tracking
Third parties, including Google (through Google Analytics and Google Ads), Meta, LinkedIn, and OpenAI, use cookies, pixels, and similar technologies on our Sites to collect information about your online activities over time and across different websites, including to show you advertising for our Services on other websites and to measure that advertising. Advertising cookies and pixels load only if you click ‘Accept’ on our cookie banner. You may opt out by using the cookie preferences on our Sites.
Correcting, updating or deleting your Personal Information
To review, update or delete your Personal Information or to ensure it is accurate, you may log in to your account to make any changes, or contact us at help@marginedge.com.
Data retention
We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services, contact us at help@marginedge.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Notification of Privacy Policy changes
We may update this Policy to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the email address specified in your account) or by posting a notice on this site.
Response to Do Not Track Signals
Our Sites do not respond to web browser “do not track” signals.
Additional disclosures for California residents
This section applies to California residents and supplements the rest of this Policy. Terms used in this section have the meanings given in the California Consumer Privacy Act, as amended (the “CCPA”).
Categories of Personal Information we have collected in the preceding 12 months: (1) identifiers, such as name, email address, mailing address, phone number, IP address, and account identifiers; (2) Personal Information described in Cal. Civ. Code § 1798.80(e), such as bank account numbers, routing numbers, and payment card information used in our bill pay services; (3) commercial information, such as records of services purchased and payments made; (4) internet or other electronic network activity information, such as browsing and clickstream data on our Sites; (5) professional or employment-related information, such as title and company name; and (6) sensitive Personal Information, such as Social Security numbers used as taxpayer identification numbers, which we use only to verify identity and meet tax reporting obligations.
Sources: We collect Personal Information directly from you; automatically from your device when you use our Sites; from the business you work for or that pays you through our Services; from systems our customers connect to the Services, such as point-of-sale and accounting systems; from service providers, such as bank account verification and identity verification providers; and from business partners, data providers, and publicly available sources.
Purposes: We collect, use, and disclose Personal Information for the business purposes described in “What we do with your information” and “Who we share it with” above.
Disclosures: In the preceding 12 months, we have disclosed each category of Personal Information listed above for business purposes to the categories of recipients described in “Who we share it with” above.
Sale and sharing: In the preceding 12 months, we have “sold” or “shared” (as those terms are defined in the CCPA) identifiers, such as IP address and cookie and device identifiers, and internet or other electronic network activity information to advertising networks and social media platforms, including Meta, LinkedIn, Google, and OpenAI through cookies, pixels, and similar technologies on our Sites, for advertising and analytics purposes. You have the right to opt out of the sale or sharing of your Personal Information by using the cookie preferences on our Sites. We do not knowingly sell or share the Personal Information of consumers under 16 years of age. We do not use or disclose sensitive Personal Information for purposes that would give you the right to limit its use under the CCPA.
Retention: We retain each category of Personal Information for as long as necessary for the purposes described in this Policy, as follows: identifiers and professional or employment-related information, for as long as the related account is active and for a reasonable period afterward to fulfill any remaining business, legal, or contractual obligations; bank account, payment card, and other financial information, for as long as the related payment relationship is active and for at least two years after it ends, to meet ACH authorization record requirements; commercial information, such as records of payments, for at least seven years after the transaction, to meet tax, accounting, and audit requirements; internet or other electronic network activity information, including records of AI assistant connection activity, for as long as needed to operate, secure, and improve our Sites and Services, analyze their use, and investigate incidents; and sensitive Personal Information, for as long as necessary to verify identity and meet tax reporting obligations. We may retain Personal Information longer where required by law or as needed to resolve disputes or enforce our agreements.
Your rights: Subject to exceptions under the CCPA, you have the right to (1) know what Personal Information we have collected about you, including the categories of Personal Information, the categories of sources, the business or commercial purposes for collecting it, the categories of third parties to whom we disclose it, and the specific pieces of Personal Information we have collected; (2) request deletion of your Personal Information; (3) request correction of inaccurate Personal Information; (4) opt out of the sale or sharing of your Personal Information; and (5) not receive discriminatory treatment for exercising your rights.

We will verify your request by matching information you provide with information we maintain. You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof of your written authorization and may require you to verify your identity directly with us.
